Professional liability and cyber come before general liability

General liability covers bodily injury and property damage. Your lease requires it and you need it. But for most Frisco businesses it is not where the largest exposure sits.
If you provide advice, design, consulting, software, financial services, recruiting, marketing or any licensed professional service, your real exposure is being accused of performing that service incorrectly. That is professional liability, or errors and omissions, and it is entirely absent from general liability. Frisco client contracts increasingly require it at one to five million dollars, and the requirement lives in the master services agreement rather than the lease, which is why owners discover it mid-deal. Medical and dental practices need the professional version specific to their field, plus considerations around patient records that overlap directly with cyber. Cyber liability is now a core coverage rather than an add-on. General liability excludes data breach completely. A cyber policy funds breach response, notification, forensics, legal defense, business interruption from an outage, ransomware, and funds-transfer fraud. That last one is the claim actually happening: a compromised email account leading to a fraudulent wire, which nothing else you own covers. For a practice or firm holding client or patient data, the exposure is not proportional to your revenue. Send us your client contracts and your lease before we quote. Required limits and specific wording are in those documents, and building to them is faster than retrofitting under a deal deadline.

Franchise requirements, build-outs, and business income

Frisco has a high concentration of franchise retail, fitness, food and service businesses, and franchise agreements specify insurance in detail. They typically require general liability at set limits, additional insured status for the franchisor, specific property limits, business income with a stated period of restoration, and often employment practices and cyber coverage. A policy that satisfies your lease can still breach your franchise agreement.
Send us the franchise agreement's insurance section. It is more prescriptive than most leases and it is not negotiable. Tenant improvements are the most underinsured item in Frisco commercial policies. Build-outs here are expensive, and if you funded the finishes, the kitchen equipment installation, the specialized electrical or the fixtures, that is your property rather than the landlord's. Insure it for what it would cost to redo, not what you have depreciated it to on your books. Business income and extra expense. If a fire, storm or water loss closes you for two months, property coverage repairs the space while business income pays lost profit plus continuing rent and payroll. Frisco commercial rents are high, which makes the continuing-expense portion large. Extra expense pays to operate temporarily from another location, which for a service business usually matters more than the physical repair timeline. Equipment breakdown is worth pricing for food service, fitness and medical operations, since it covers mechanical and electrical failure of your own equipment that standard property coverage excludes, including the resulting spoilage and interruption.

Employees, autos, and umbrella limits

Employment practices liability is the coverage Frisco employers most consistently overlook. It responds to wrongful termination, discrimination, harassment and retaliation claims, which for a professional or franchise employer are far more likely than a premises injury. Defense costs on a claim with no merit are substantial, and general liability excludes all of it.
Workers compensation is optional for most private Texas employers. Non-subscriber status forfeits the statutory liability protections comp provides, so an injured employee can sue for negligence directly with fewer defenses. Many franchise agreements require comp regardless of state law, and many commercial clients require it of vendors. Commercial auto and hired and non-owned auto liability. If vehicles are titled to the business you need commercial auto. Even with no company vehicles, hired and non-owned coverage protects the business when an employee drives their own car to a client site, a bank run or a supply run. Their personal policy protects them, not the company, and it excludes business use in the first place. It is inexpensive and it is missing from most policies we review. Commercial umbrella sits above general liability, commercial auto and employer liability. Larger Frisco client contracts and many franchise agreements require five million dollars or more, and buying an umbrella is far cheaper than raising each underlying limit separately. It only functions if the underlying limits meet the umbrella's requirements, which is why we prefer to place the whole program rather than a single piece of it. Carrier appetite by class code varies enormously in professional services, medical and food. Shopping more than 56 insurance carriers and markets is where both eligibility and price are decided.

"Our franchisor rejected our policy twice and we could not work out why. Rainbow read the franchise agreement line by line, rebuilt the program to match, and got it approved. They also added employment practices coverage we had never been offered."

Frisco Business Insurance FAQs

My client contract requires E&O and cyber at limits I do not have. How fast can you fix that?

Usually quickly. Send us the master services agreement, since the required limits and specific wording live there rather than in your lease. We build the policy to the contract and issue the certificate, which is faster than quoting first and rewriting under a deal deadline.

My franchise agreement has an insurance section. Does my current policy satisfy it?

Often not. Franchise agreements are more prescriptive than leases, typically requiring specific limits, additional insured status for the franchisor, a stated business income period of restoration, and sometimes employment practices and cyber coverage. Send us the section and we will build to it exactly.

Do I need cyber liability for a small Frisco practice?

If you hold client or patient data or move money by wire, yes. General liability excludes data breach entirely. Funds-transfer fraud through a compromised email account is the claim currently hitting small firms, and nothing else in your program covers it.

Why is employment practices liability worth buying?

Because for a professional or franchise employer, a wrongful termination, discrimination or harassment claim is considerably more likely than a customer injury. Defense costs are substantial even when the claim has no merit, and general liability excludes the entire category.
